House of Lords, 1706-1708]_, pp. 37-38:

2325. Feb. 10 [1706-07]. Duke of Beaufort's Estate Act.---Petition
of Henry, Duke of Beaufort, praying leave to bring in a Bill to
discharge divers of his manors, etc., from the payment of the portions
of his daughters and younger sons by his present wife, and to charge
other manors with the same. Upon the Petitioner's marriage with Mary,
late Duchess of Beaufort, his first wife, various manors of his in the
counties of Gloucester and Monmouth were vested by means of an Act of
Parliament in trustees for a term of five hundred years in trust to
raise portions for the daughter of the marriage in case there should
be a failure of male issue, viz., for one such daughter 15,000l. and
for two or more 20,000l; then with limitations to the Petitioner's
first and other sons successively in tail male by any other wife, and
then to the Lord Charles Somerset, the Petitioner's brother, for life
with remainder to his first and other sons successively in tail male,
and several remainders over to other branches of the Petitioner's
family. The Petitioner had no issue by his first wife now living, and
the said term for 500 years is by no means determined, and no
provision is made by the said Act for the Petitioner's daughters or
younger children by any other wife. On his marriage with Lady Rachel
Noel, daughter of Wriothesley, Earl of Gainsborough, the Petitioner
settled divers manors, etc., in the counties of Middlesex and
Southampton for the raising of portions for the younger children of

(a) 17 Feb. Report of the two Judges with regard to the above
petition. The Judges state that the allegations contained in the
petition are true; that all the persons interested have signed the
petition, except Henry, son of Lord John Somersett, deceased, who is
beyond the seas and very near fourscore years and who only has a
remote interest; Edward Somersett, his son; Charles Somersett and
Henry Somersett who are beyond the seas, sons of Charles Somsersett
who has signed the petition and declares that if his sons were here,
they would be willing to sign; that all the trustees of the settlement
of the present marriage have signed the petition, except Algernon
Grevile who is beyond the seas; ...
