Hello All,

In the course of seeking to correct or complete the pedigrees of certain
medieval Yorkshire families, a number of issues concerning the family of
Hilton (and of the Hiltons of Swine and Winestead, in particular) were
noted.
The following (Part I) is a pedigree of the senior Hilton line, giving the
descent from their earliest known (Hilton or Tyson) ancestor, William Tyson
(or Tison) of Shilbottle, Northumberland.

This pedigree in particular bears on the descent of the later Lords
Hilton, and many more besides. Leaving aside the descendants of the cadet
line of Swine and Winestead, the late Queen Mother (and thereby QE II) are
among the better known descendants of the Lords Hilton. For those interested
in reviewing that descent or any other relationship, the record for the last
Lord Hilton in this pedigree provides the identification number as assigned
in Leo van de Pas' "Genealogics" website.

The next post in this thread will provide the pedigree for the Hiltons
of Swine, and address the problem(s) noted regarding that family.

Hello All,

In my prior post, I noted that there was a problem concerning the
previously accepted pedigree of Hilton of Swine and Winestead as to
Constance de Mauley, 2nd wife of Sir Robert Hilton (d. before Feb 1400/01).
Specifically, as Adrian Channing noted recently, the ancestry of Denise
(Hilton) Hilton, wife of Sir William Hilton (d. 25 May 1435) was 'corrected'
in CP XIV to read that:

" He m Denise, da. of Sir Robert de Hilton, of Swine in Holderness,
by Constance, da. of Piers, 4th Lord Mauley, by Constance, 1st da. and
coh. of Sir Thomas de Sutton, of Braunsholm Castle and Sutton, also in
Holderness [3rd Lord Sutton of Holderness]. "

Sir Robert Hilton married 1stly say 1360-1370 Isabel _____ , and 2ndly
ca. 1395 to Constance de Mauley [2]. The dates we have concerning certain
children and grandchildren of Sir Robert make the placement of Constance de
Mauley as their ancestress either problematic or impossible:

1. Isabella Salvin or Salvyn, daughter of Roger Salvin of Herswell
and an unidentified daughter of Sir Robert Hilton, made a will
dated 1428, identifying her uncle Sir Robert Hilton (d. bef
22 Dec 1431, eldest son of Sir Robert above) as a beneficiary
and co-executor of the will:

" Item domino Roberto Hilton, avunculo meo, tantum lego de bonis
meis pro mensa mea, quantum voluerit recipere. " [3]

For Isabella to have been a granddaughter of Constance de Mauley,
her own mother would have been aged say 33 (and possibly younger)
when she (Isabella) wrote her will in 1428. What this would do
to Isabella's possible age, placing her as aged say 18 and likely
younger when writing her will, makes this relationship most
unlikely.


2. Sir William Constable of Halsham, son of John Constable (d. bef
28 Jan 1407/08) and Maud Hilton (another daughter of Sir Robert),
made a grant to his mother of her dower lands on 28 Jan 1407/08,
naming his uncle Sir Robert Hilton:

' Sir William Constable to his uncle Sir Robert Hilton, his relative
Sir Robert of Hilton, his brother Thomas Constable, John of Holme and
John Grene property all his property in Tharlesthorpe Otringham,
Kayingham, Halsham, Pauleholme, Paule, Dodyngton, and Hedon; and
reversion of all property held by his mother Lady Matilda Conesstable
and of all property held of him for terms of lives
Witn. Sir Robert Twier, Sir John of Routh, Sir Stephen of Thorp,
Master Anthony of St. Quintin rector of Hornse, Master William of
Retherby rector of Wynested, John Pigot rector of Rosse; John Disney,
Ralph of Lellay, James of Hedon, John of Croft and John Arnald esqs.
Given at Halsham. ' [4]

Assuming that Sir William was knighted at an age of 14 or older,
he was likely born January 1393/94 or before (and probably before).
The identification of Sir Robert Hilton, then living, as his uncle
makes it certain that Maud, mother of Sir William Constable, was
a daughter of Sir Robert (d. 1400/01) and sister of Sir Robert (d.
bef 22 Dec 1431). His mother, Maud Hilton, could not then have been
a child of Constance de Mauley, but rather of Isabel, the first
wife.


3. Sir Robert Hilton, later Lord Hilton, son of Sir William and Denise
(Hilton) Hilton, was born in 1385 or before, and probably before 25
May 1385. He was aged 50 and more at his father's IPM, his father
having d. 25 May 1435 [5].

This would place the birth of Denise, mother of Robert as occurring
no later than 1371, and likely before.


4. Sir Robert Hilton (d. bef 22 Dec. 1431), son and heir of Sir Robert
(d. 1400/01), was born say 1370-1380 and possibly before, based upon
evidence concerning his career in Parliament and elsewhere. He had
the grant of the marriage and wardship of Brian Stapleton from Thomas
de Percy, earl of Worcester, Feb. 1397; together with his brother-in-
law John Constable of Halsham, he was the attorney for King Henry IV
in delivery of seisin of an estate in Holderness to Thomas of
Lancaster, 3 Nov 1399. He further had letters patent dated 7 Nov
1399, being then retained as an 'esquire of the body' of Henry IV.
He was summoned to attend a meeting of a great council at Westminster
as a representative for Yorkshire, August 1401 [6], and as noted
above, named by his nephew Sir William Constable of Halsham in his
grant of 28 Jan 1407/08.

The foregoing information makes it certain that of the children of Sir
Robert Hilton (d. 1400/01), at least 4 (his heir Sir Robert; Maud, wife of
John Constable of Halsham; Denise, wife of Sir William, Lord Hilton; and the
unnamed wife of Ralph Salvyn of Herswell) were not the issue of Constance de
Mauley.

On top of the chronological impossibility of Denise (and the others) being
daughters of Sir Robert de Hilton's wife Constance, based on her marriage to
Robert about 1395, Roskell's article disagrees with CP about Constance's
identity (here and in the article on Mauley, vol. 8, p. 568, note h, which
says that Constance, daughter of Piers de Mauley and Constance de Sutton,
"is said to have" married Robert de Hilton, of Swine).

Instead, Roskell et al say that Robert's wife Constance was the _widow_ (not
the _daughter_) of Piers de Mauley. The footnote to the paragraph in
question (III 196) cites Yorks. Arch. Soc. Rec. Ser. lix 14-15, 23;
C139/47/5 and adds "The evidence of Constance's third marriage [i.e. to
Robert Hilton], in or before 1395, has been overlooked because of a mistake
in the calendar, where her name is given, wrongly, as Margaret (CPR, 1391-6,
pp. 654-5)."

If this is correct, the 1371 date of marriage for Piers and Constance
becomes irrelevant, but Roskell et al have Constance's second husband, Sir
John Godard, dying after March 1392, in which case her marriage to Robert
Hilton could not have been much before 1395.
