I have been on a research sabbatical in London for the last eight
months working on the disentanglement of the lives of Thomas Malory of
Newbold Revel from Thomas Mallory of Papworth St. Agnes. My work has
had to go backwards and forwards several centuries in each direction,
as well as outwards and inwards. A more academic way of putting it
would be that it has both diachronic and synchronic aspects. In any
case, the lives of these two men have always been entangled and
disentangling them has been quite a job. In the process, I have also
done significant research on the Mallorys, but the de Dribys, the
Papworths (a later posting), and the Burleys of Shropshire and
Herefordshire (also a later posting).
I thought I would share the preliminary results of my studies relating
to the de Driby ancestry of Thomas Mallory of Papworth St. Agnes
(1425-1469)
1. Simon de Driby, the first identifiable lord of Driby, would have
been born around the end of the first quarter of the 12th century.
Nothing is known about him directly.
2. Robert de Driby, son of Simon de Driby, would have been born around
the middle of the 12th century. His wife may have been Margaret who
was fined for slander in 1194, but again she may be the wife of the
Simon de Driby of the next generation. Many permutations on this them
are possible.
3. Simon de Driby, the son of Robert the son of Simon. Quite a bit of
information is available about him for the period 1200 to 1220.
4. Sir Robert de Driby, for whom information is available between 1230
and 1249 when it appears he has passed away. He seems to have had a
wife Andrina who survived him, but whether this woman would have been
the mother of his children cannot be determined. In addition to Driby,
he had feudal tenure over lands in Baston and Carleby.
5. Sir Simon de Driby, Sir Robert's successor, lived to a suitably old
age, with records concerning him spanning from around 1248 to 1290.
Assuming him to have not been born much before 1225 and a rough
generation-length of 25 years, we can tentatively assign approximate
years of birth to the preceding generations. He seems to have had a
brother Robert de Driby who only appears once as a witness in 1254.
Sir Simon's wife's name was Alice the daughter of Hugh the son of
Ralph who held the Manor of Lavynton. They had three sons who can be
identified, because family lands appear to have been distributed among
them. They will be covered in the next section.
6. Hugh de Driby was given the Manors of Driby and Winthrop, thus he
would have been the oldest. Hugh is dead by 1322 when his brother
Robert's oldest surviving son Simon is possessed of his holdings.
Robert de Driby and Joan Tateshall were deeded property by Robert's
father Simon, but Robert is already dead when his wife inherits
various properties in Leicestershire in 1308 as her share of the
Tateshall estate. Their children will be discussed under the
succeeding generation.
Ralph de Driby must have been a third son. He was given the properties
brought to the de Driby family by his mother, as well as land in
Carleby which had already belonged to the de Dribys a generation
before in his grandfather's time. By 1306 Ralph is shown as being 13
marks in debt, a serious sum of money for his time. He must be dead by
1318, by which time his son Hugh has succeeded him.
Possibly there was yet another brother who had a son Robert. This
Robert appears in Lincolnshire records in 1359 and may be the same
person who appears as Sir Robert de Driby in 1360.
For reasons to be explained later, I do not think Anketin Mallory's
wife Alice de Driby's grandfather Thomas can be affiliated here, even
though it might look attractive to do so on a tentative basis.
7. Hugh de Driby son of the preceding generation's Ralph de Driby owed
25 1/2 marks as of 1318. He sold off the Manor of Lavynton in 1325/6.
He afterwards disappears from history.
Sir Simon de Driby the oldest surviving son of Robert de Driby and
Joan Tateshall had, by 1322 when he passed away, inherited all the de
Driby properties, except those which his cousin Hugh had alienated
from family possession, most likely to pay off debts. Sir Simon's wife
Margery survived him. All Sir Simon's properties come under the
possession of his younger brother John, who is a priest.
In 1329, only days before she died John's mother Joan Tateshall
entailed her Tateshall inheritance (all in Leicestershire) on her son
John and, after him, to his heirs, which on the surface appears quite
strange, as Joan Tateshall's own properties, under the common law of
the time, would have automatically gone to her son anyway and, from
there, to her daughter Alice (the ancestress of the medieval Barons
Cromwell and many other noble families). Furthermore, if Joan had not
created this entail, John could not have alienated the land to anyone
else without his sister's permission as she was his next heir. By
creating an entail, Joan was actually making it possible for John to
pass Joan's Leicestershire inheritance on to someone else other than
her daughter Alice, lady Bernake. It possibly means that the actions
John took some years later had actually been planned by Joan Tateshall
before she died. John enfeoffs a set of feoffees to assign the
Tateshall-derived Leicestershire properties to John de Driby and his
wife Amy de Gaveston (also, Anne de Gaveston), the daughter of Peter
de Gaveston and the joint issue of their bodies, failing which to Sir
John de Kirketon and his issue, failing which to Sir Robert de
Littlebury and his issue, failing which to John's own right heirs (his
sister Alice Bernake). Thus, according to this entail, the younger
John de Driby, should he not have any issue by Anne de Gaveston, could
not pass on Joan Tateshall's Tateshall inheritance to children by
another wife. (I will call John's wife Anne from here on out because
that is how she always appears in later documents, though she does
appear as Amy in the earliest ones. I would also like to note that I
have seen the change from Amy or Amicia to Anne in documents
concerning other women of the same period. For some reason, Amy went
completely out of fashion among women in years approaching the
mid-14th century and quite a few former Amys started calling
themselves Anne. It's a mystery I shall probably never understand.)
Clearly, this entail was aimed at Anne de Gaveston, not at her husband
John de Driby. Anne, thus, was someone whom Joan Tateshall seems to
have thought of as a co-heiress of at least the Tateshall properties
and as much deserving of an inheritance as her own daughter Lady
Bernake. The following can never be proven, but my gut instinct goes
with the idea that Joan Tateshall had a daughter other than Alice who
was the woman by which Peter de Gaveston had his illegitimate daughter
Anne and who had passed away (perhaps in a nunnery) without visible
heirs enough before the death of Joan Tateshall to give her time to
arrange the necessary entailment providing for Anne de Gaveston's
inheritance. This strange set of entailments, first to her son John
who was a priest, then from John the priest to Anne de Gaveston and
her husband John de Driby, would, thus, be Joan Tateshall's way to
grant an inheritance to Anne without having to clarify why she was
receiving an inheritance.
At this point, I need to stop my narrative to state that what I have
just outlined represents pure speculation on my part and should not be
interpreted as a proven fact (which is something quite different) or
something I have wedded myself, too. I throw it out only as a possible
explanation for a very unusual set of land transactions whereby a new
de Driby family was being established, but not with Tateshall lands
rather than de Driby lands.
8. John de Driby, son of Thomas de Driby, if his wife Anne were indeed
a neice of John the priest, would have been perhaps a third or even
fourth cousin of his wife in order to avoid the necessity of getting a
special dispensation for them to get married. Whatever the
relationship, though, it was clear that being a son of Thomas de Driby
gave the younger John de Driby no right whatsoever to the de Driby
estates. In fact, if he had not been chosen to marry Anne de Gaveston,
whether by Joan Tateshall, John the priest, or by Queen Philippa's
manipulation of events, he would probably have lived and died without
any record at all of him ever having appeared. Records of him,
however, as a result of the lands his marriage brought him, exist
until 1368 when he gives land to Sir Robert Tuchet, perhaps indicating
a recent marriage to his daughter Alice (Could Lady Bernake have been
the Godmother?). In an age of child marriage, this would indicate,
even if Alice had already been married several years at the time land
was granted to her first husband, a birth of perhaps as late as 1345
to 1350 for John and Anne's daughter. I have found records of Anne de
Gaveston as late as 1348, so a date of birth this late would be
entirely possible, if we assume Anne was born perhaps no earlier than
the very beginning of the reign of Edward II. In connection with this,
we need to remember that, from the very beginning of his reign, the
relationship between Edward II and Piers de Gaveston had set tongues
wagging, so perhaps Anne's conception was meant as a camouflage to
indicate to the world that Piers de Gaveston was a "real man" after
all and, therefore, a safe companion to have around the king. Perhaps
it was later, though. There is no way of knowing, but a date of 1310
plus minus three years for Anne's birth is reasonable.
John de Driby the son of Thomas would have been born roughly in the
same year as his wife Anne. As they married in 1338, they both would
have been close to 30 at the time of their marriage and were married
at least 10 years. They would have certainly had more children than
Anne and she may very well have been their youngest child, as well as
the only one to survive. No further mention of Anne appears after
1348, though her husband appears from time to time for another 20
years. This leads me to believe that Alice and her father John
survived the Black Death that killed roughly one third of England's
population in 1349, but that Alice's mother Anne and any other
siblings Alice might have had did not.
9. Alice de Driby has been much discussed and I think, as genealogists
should always aim for truth in ancestry, we all owe a vote of
gratitude to Paul Reed for bringing her existence to everyone's
attention and for the great care which he always puts into his work.
However, precisely because she has been much discussed in recent
years, I do not think it necessary to include anything further about
her in this posting, though I certainly have uncovered various details
about her life that probably are not yet common knowledge. However,
the details are not enough to justify a full-length study of her,
which would be quite long indeed, because she was, in very many ways,
an amazing woman whose actions were to set on course a train of events
that changed the course of various aspects of English history over the
next century.
