I haven't been following this matter closely, but as I remember the question and understand it from a few years ago, Douglas Richardson found an extract of a warrant dated 1296 for "Robert de Brus, earl of Carrick and lord of Annandale and his wife Maud". He first identified this as Robert VI (died before 4 April 1304, son of Robert V "the Competitior" and father of Robert VII "the Bruce" later king of Scots). But later Richardson changed his mind and claimed that Maud Fitzalan had actually married Robert the Bruce instead, as his second wife, in 1295, and even that she was probably the mother of his daughter Marjorie who transmitted the crown of Scotland to the Stewarts.

The only basis as far as I recall for this switch was the fact that the extract titled Robert "earl of Carrick" in 1296, and this earldom had been transferred from Robert VI to his son Robert VII in 1292 on the death of the heiress Margaret, who was wife of the elder Robert and mother of the younger.

However, this flimsy extrapolation from a mere translated summary is surely contradicted by the second title given, "lord of Annandale", since Robert senior did not transfer that title to his son at the same time, i.e Robert "the Bruce" may have been earl of Carrick in 1296 but his father was still lord of Annandale at that time.

So until we have the text of the original warrant, and know from this and other evidence precisely what titles the two Roberts actually used for themselves at what times, and how they were titled by chancery clerks at the same times, there appear to be no good reasons for preferring one over the other as second husband of Maud Fitzalan.

Maybe it's worthwhile asking this question of DR - but then I might have missed exchanges on the issue, because as I said I have not been following these threads.
