Researchers,

I'm afraid I might need someone a bit smarter than me at the legalese to
help decipher two records I've found which appear to conflict.

1) John Salerne of Iden to Robert de Passele, son and heir of Robert de
Passele kt
The reversion after the death of RP's mother Ann of three pieces of land and
100s rent (which JS holds for a term of 6 years by her demise), which RP
confirmed and released to JS by a recent charter [?the manor of Mote]
JS declares that RP's charter, and the £60 bond which protects it, will be
void if RP pay £3 6s 8d by 30 Mar 1399 at JS's manor of Leigh [in Iden], and
£13 6s 8d on 24 Jun 1399
W: Robert Echynghame, Robert Oxenbrege, Thomas Oxenbregge, William
Marchaunt, John Gotele, William Mot, Henry Gotele

but for some reason doesn't show as much as the copied version from some
months ago, as pasted above. FILE - Defeasance of mortgage - ref.
OR/12/1 - date: 18 Dec 1398

This appears to me to indicate Anne is dead by this time.

Manor of Mote, Sussex

Nos. 51 and 52 are two charters relating to the holdings of a large manor in
Sussex and examples of the business transacted in a manor court. The first
is a "grant" by Robert Erchynghame, Thomas Grene, chaplain, and John
Chesham, feoVees (to uses) of Robert de Passele, knight, to Anne, widow of
the said Robert, of all her late husband's lands in Idenn, Playdenn,
Pesemerche, Bekkele, Northihame, and Ywhurste, together with the advowson of
the free chapel of Legh, for the term of her life; with remainder to the
right heirs of Robert. It is really an acknowledgement by the feoffees that
Ann is the true landholder and lord of the manor.

Manor of Mote, Sussex

Acknowledgement by John Sergeaux, clerk, reciting that, whereas Ann, late
the wife of Robert Passele, knight, holds the manor of Mote with its
appurtenances in the parishes of Iden, Playden, Pessemersh, Bekle,
Northyham, and Ywehurst in the county of Sussex for her life, and also
certain lands in Rigge and Frenshcourt for her life, in dower, which
premises, on the death of Ann, ought to revert to the said John as appears
by a grant made to him by Robert son of Robert Passele, knight, the said
John grants that the premises, on the death of Ann, shall remain to the said
Robert son of Robert and Philippa his wife and their heirs forever. Given at
the manor of Mote on 26 October, 1 Henry IV. See the seal of John de Passele
in the display of Commoners' Seals.

These (51 & 52) are from the venerable

and appears to indicate that Anne was living in 1399.

The 1395 record, and deed #304 from the Harvard site indicate that Anne was
alive and widowed in 1395. But was she dead in 1398 or 1399 by the above
records?

Also, does anyone have relatively easy access to the biography or William
Swinburne from Roskell's House of Commons (pp 550-1) that Douglas Richardson
cites in PA pg 334?

I'm in New South Wales for a couple of months, so haven't any of my
papers or reference material here unfortunately, but it seems the full
text you quote is still available on A2A, just hidden a bit. If you go
to the page where the extract now appears (ie directly from the search
page), and note the document reference, and then click on "catalog in
full" near the top right, and find the reference number in the
resultant list, you will see much more information. This is a handy
tip for all A2A items: always look at the full catalog item, as it may
contain much more detail than the initial abstract reference.

Assuming the RP the elder did not have two wives named Anne (one the
mother of RP the younger, and the other his widow), I think the
abstract of the 1398 deed can be read to refer only to the sale of the
reversion - ie a future event. Thus, RP the younger has originally
sold a six-year term of the reversion to JS, contingent upon Ann's
death, and is now given the chance to buy it back. The abstract is a
bit confusing, as it could be construed to mean that JS holds the
properties rather than a term of the reversion.
