Papal Bull 1462 Pius II,1464 Paul II,Statute Rolls Ireland E

To All Who May be Interested,

The Papal Bull of Absolution under Pope Pius II, July 20, 1462 and
confirmed under Pope Paul II September 16, 1464 concerning the marriage
of James Butler and Sabina Kavanaugh, even tho with-in the prohibited
degrees of consanguinity is upheld.
This meant that Theobold and Edmund their two first born were
legitimate.

Notary by apostolic and imperial authority.
"Calendar of Ormonde Deeds" vol. III p.199-203 latin text.

Further:
"whereafter affiance had between said James and Sawe Kavanaugh his
wife, before espousals there was issue Esmund and Theobold which, by
law of the church are legitimated by subsequent marriage, it is
ordained by the authority of this present parliment that said Esmund
and Theobold be made and adjudged legitimate, etc,"

It was not until 1501 that Piers Butler of Ossory gathered the Bishop
of Ossory and others and started with notory affidavits to make Edmund
and Theobold illigitimate.

"October 18, 1536, INSPEXIMUS by Henry VIII Act of Parliment took
steps to have Edmund and Theobold made illigitimate",
Calendar of Ormonde Deeds, vol III p. 206-209

But not by
Papal Mandate, Henry VIII had already been excommunicated from the
Catholic Church himself, so that Edmund and Theobold would not be in
the line of succession for the Earldom of Ormonde. Piers Butler
actually started when he murdered James Ormond Butler, son and heir of
John, 6th E of Ormonde in 1497. From this period thru 1538 he made
constant attempts to re-assure his succession. Even tho there were wars
and The Plantations eras of Ireland , it was pretty much after this
time of 1497 that Ireland was controlled politically thru the English,
and the Irish Parliment was either ignored or their representatives
were made sure to represent the interest of England, I believe.

So all those books and geneological sights that talk about the
illigitimacy of Edmund and Theolbold, as "they lay under their parents
cloak when they were married" and Piers Butler the 8th Earl of Ormonde
was legitimate was and is wrong, even from this standpoint. There is
more, much, much more concerning James-his sons and his cousins, sons
of Thomas, 7th Earl of Ormonde, that I will also show documentation on.
