Eva (? of Mentieth ), 1st wife of John Comyn I, Lord of Bade

Dear Newsgroup,
Since the Publication of Douglas Richardson`s
Magtna Carta Ancestry, a larger portion of the world knows that John Comyn I of
Badenoch (the Red # 1) d 1277 married for his 1st wife an unknown woman named
Eva and 2nd before 1269 Alice , whom Richardson identifys as Alice, daughter
of Willam and Lucy ( Fitz peter) Roos ( See MCA pp 201- 202 for details of
this identification) At any rate, According to Alan Young`s " Robert the
Bruce`s Rivals : The Comyns 1212-1314 p 59 when his uncle Walter Comyn died in
October- November 1258 He recieved the Lordship of Badenoch which Walter had
been granted. His Uncle had also been Earl of Mentieth in right of Isabel, the
heiress of Maurice, 3rd Earl of Mentieth. The Lady married an English knight,
Sir John Russell and the new Lord of Badenoch in 1260-61 violently seized them
and forced them to resign their rights to him,which seems a rather mad thing
to do unless He had some sort of heritable right to fall back on. In any
event King Alexander III and the Scots nobles ordered him to give up the lands,
which He did ( Young ibid p 66) In the end, No negative action beyond
disallowing the seizure of the title was done to Comyn, so it seems probable that Eva
was a near relative of Isabel`s.

And what about Menteith ?
After Walter died in 1258, I don't have any notes on what happend to Isabel
but her sister Mary had married Walter Stewart and I have him marked "Earl of
Menteith, Jure Uroxis" with *their* son Alexander marked as the next Earl of
Menteith. So I'm presuming that Menteith passed peaceably to her sister Mary
and husband Walter?

Dear Will,
Yes. King Alexander III of the Scots upon censuring John
Comyn ( Red # 1) of Badenoch ordered him to turn the Earldom of Mentieth over to
Walter Stewart [son of Walter the Steward and his wife Mary, who was related
to, but I`m unsure if a sister or cousin to Countess Isabel (Mentieth)
(Comyn) Russell of Mentieth. Their descendants were also known by the surname
Menteth. Considering what Comyn had dared to do, being refused possession of his
ill gotten Earldom if Eva had in fact next in line to inherit it was the merest
cuff on the wrist. The Scots Kings may not have been as wrapped in in royal
perogative as the English, French, or any of the Spanish Kings of the time, but
bestowing the Earldom of another without the express prior consent of the
monarch could not be taken lightly.
