Berkeley acquisition of Tetbury

Like others here, I have been interested in the acquisition of Tetbury
by the Berkeleys, since it bears on the question of whether or not Peter de
Braose of Tetbury had posterity after the failure of the Greville/Cooksey
line.

The presumed explanation has been that the Berkeleys (and Howards) were
the next of kin, being descended from Peter's older half brother. The
explanation has always seemed dubious to me, and has been dealt a
significant blow in discussions here recently.

One other explanation that has occured to me is a false genealogy, as
follows. The Berkeley heir at the time of extinction of the
Greville/Cooksey line was a descendent of Thomas (Plantagent) "of
Brotherton", earl of Norfolk, whose widow was Mary, sister of Thomas de
Braose, and therefore almost certainly daughter of Peter de Braose of
Tetbury. The Berkeleys appear, in fact, to be descended from Thomas's
first wife, not from Mary, but if this were not understood at the time of
transfer of Tetbury, it could easily have been believed that the Berkeley's
were descended from Mary, and thus closer heirs than we now know.

Secondly, the grant of Tetbury to Peter was from his father William,
though Peter was not his father's heir. Under typical medieval attitudes,
this granted only a tenure subordinate to William's actual heirs, who
eventually included the Berkeley's. Thus the Berkeleys could already have
been the overlords of Tetbury when lower level tenure became an issue, and
it would have been the overlord's job to judge the issue. They could have
judged Tetbury to default to themselves on various grounds, real or
imagined.
