Again, the fundamental reason for the heraldic limbo in Ireland is evidenced
by an FOI'D e-mail from Chief Herald O Donoghue dated around June 2002, in
which he indicated that the Attorney General had advised 'more or less' that
the Genealogical Office 'is an illegal organisation (!) and should not be
granting arms or recognising chiefs', adding, despite the fact that he
himself is a grantee, 'I'm tempted to agree!'. As outlined by me in previous
posts, the key legal problem is doubt over the legitimacy of continuing to
exercise a state power such as granting of arms on the basis of assumed
inheritance of a royal prerogative by the new Irish state after 1922. A
clear heraldic statute is required if grants of arms are to be resumed and
doubts over the validity of grants since 1943 removed. Although I am
personally not keen on official involvement in heraldry in a republic, I
consider that the number and no doubt the status of grantees requires a
resolution by statute, and I have taken the trouble to draft the heads of a
bill. Some past grantees and those waiting for the signing of patents since
2003 may have taken legal advice, and I would be surprised if it is not
couched in terms similar to the above, with perhaps a warning that any legal
action to confirm grants might fail in view of the present confused legal
situation.

I am glad to see that the death notice of Terence Maguire (RIP) made no
reference to his claim to be a chief, 'The Maguire, Prince of Fermanagh'. He
was not a chief, and the claim was effectively concocted with the assistance
of his deceased grandnephew, Terence MacCarthy, himself as is well known a
former bogus chief, 'The Mac Carthy Mór, Prince of Desmond'. The validation
of the bogus claims of these gentlemen and other individuals by the Office
of the Chief Herald of Ireland/Genealogical Office of course provides
another contributory explanation for the mess in which it now finds itself.
